Terms & Conditions

1. Scope
These Terms & Conditions apply to all orders placed through TrainShorts 
(operated by Christian Heinisch, hereinafter "we", "us"). By placing an 
order, you agree to these terms.

3. Conclusion of Contract
Product listings on our website do not constitute a binding offer, but an 
invitation to order. By placing an order, you submit a binding offer to 
purchase the selected products. We will confirm receipt of your order by 
email. This confirmation does not yet constitute acceptance of your order. 
A contract is only concluded once we send a separate shipping confirmation 
or dispatch the goods.

4. Prices and Payment
All prices shown are final prices. As we operate under the German Small 
Business Regulation (§ 19 UStG), no VAT is added or shown separately. 
Payment can be made via the methods offered at checkout (e.g. credit card, 
PayPal, Apple Pay, Google Pay, Shop Pay). Payment is due immediately upon 
placing the order.

5. Shipping
As we work with international suppliers, delivery times may vary depending 
on your location, customs processing, and product availability. Estimated 
delivery time is between 10–30 business days from the date of order 
confirmation. In rare cases, delivery may take longer due to circumstances 
beyond our control (e.g. customs delays, high demand, or carrier 
disruptions).

You will receive a shipping confirmation with tracking information (where 
available) once your order has been dispatched. If your order has not 
arrived within 45 business days, please contact us at 
support@trainshorts.com so we can investigate.

6. Right of Withdrawal

Right of Withdrawal
You have the right to withdraw from this contract within 30 days without 
giving any reason. The withdrawal period will expire 30 days from the day 
on which you acquire, or a third party other than the carrier and 
indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us (TrainShorts, 
support@trainshorts.com) of your decision to withdraw from this contract 
by an unequivocal statement (e.g. a letter sent by post or email).

Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to the delivery of sealed goods 
which are not suitable for return due to health protection or hygiene 
reasons, if their seal has been removed after delivery.

Effects of Withdrawal
If you withdraw from this contract, we shall reimburse all payments 
received from you, including delivery costs (with the exception of 
supplementary costs), without undue delay and in any event not later than 
14 days from the day on which we are informed of your decision to 
withdraw. We may withhold reimbursement until we have received the goods 
back or you have supplied evidence of having sent back the goods, 
whichever is the earliest.

You shall send back the goods without undue delay and in any event not 
later than 14 days from the day on which you communicate your withdrawal. 
You will have to bear the direct cost of returning the goods.

7. Warranty
Statutory warranty rights apply. If a product is defective, please contact 
us at support@trainshorts.com.

8. Liability
We are liable without limitation for damages resulting from injury to 
life, body, or health caused by an intentional or negligent breach of duty 
by us. For other damages, we are only liable in cases of intent or gross 
negligence, unless the damage results from a breach of a material 
contractual obligation, in which case our liability is limited to 
foreseeable, typically occurring damage.

9. Dispute Resolution
The European Commission provides a platform for online dispute resolution 
(ODR): https://ec.europa.eu/consumers/odr/
We are neither obligated nor willing to participate in dispute resolution 
proceedings before a consumer arbitration board.

10. Governing Law
These Terms & Conditions are governed by German law, excluding the UN 
Convention on Contracts for the International Sale of Goods (CISG). This 
does not affect any mandatory consumer protection provisions of the 
country in which you have your habitual residence.

11. Severability Clause
Should any provision of these Terms & Conditions be or become invalid, 
this shall not affect the validity of the remaining provisions.
